Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the FluentFlags mobile application (the "App") or accessing the fluentflags.com website (the "Website"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our services.

2. Description of Service

FluentFlags is an educational flag and country guessing game available as a mobile application and a web-based platform. The App and Website are independent services — they do not share data, accounts, or progress.

2.1 Mobile App Features

• Three game modes: Visual, Typing, and Reverse flag guessing
• 195 UN country flags and 300+ subdivision flags (states, provinces, prefectures, etc.)
• Six Chaos mode visual effects
• Learn mode with flashcard-style sessions
• Achievements, XP progression, and statistics tracking
• Platform leaderboards via Apple Game Center (iOS) and Google Play Games (Android)
• Customizable themes (1 free default theme, 3 additional themes available via Pro upgrade)

2.2 Website Features

The website offers similar gameplay features along with multiplayer modes, cloud-synced progress, and online leaderboards via user accounts.

3. User Accounts

3.1 Mobile App

The mobile app does not require or support user accounts. All game data is stored locally on your device. A locally generated player ID (UUID) is created on first launch for internal data management purposes only. You may set a display name that is used for leaderboard display via Apple Game Center or Google Play Games.

3.2 Website

The website uses Firebase Authentication. You are responsible for maintaining the security of your account credentials. You agree to provide accurate information and to update it as necessary.

4. In-App Purchases

The mobile app offers a single optional in-app purchase:

• All core gameplay features remain free, including all game modes, all flag content, all chaos modes, learn mode, achievements, and leaderboards.
• The Pro purchase is a non-consumable, one-time payment.
• Purchases are processed through the Apple App Store or Google Play Store. Pricing may vary by region and is determined by the respective platform.
• You can restore previous purchases at any time through the app's settings.

4.1 Refunds

Refund requests are handled by Apple (for iOS purchases) and Google (for Android purchases) according to their respective refund policies. We do not process refunds directly.

5. Local Data & Data Loss

All mobile app data is stored locally on your device. This means:

• Uninstalling the app will permanently delete all your game data, including statistics, achievements, learning progress, and settings.
• There is no cloud backup, sync, or data recovery mechanism.
• We are not responsible for any data loss resulting from app uninstallation, device failure, or any other cause.
• Your Pro purchase status can be restored via the App Store or Play Store, as it is tied to your platform account.

6. Leaderboards & Fair Play

Leaderboard functionality is provided through Apple Game Center (iOS) and Google Play Games (Android). By using leaderboards, you agree to:

• Play fairly and not use cheats, exploits, automation, or any other means to artificially inflate your scores
• Not modify the app, reverse engineer it, or tamper with score submission mechanisms
• Abide by Apple's and Google's terms of service for their respective game services

We reserve the right to report fraudulent scores to the platform providers.

7. Intellectual Property

The FluentFlags name, logo, app design, game mechanics, themes, and all original content are the property of FluentFlags and are protected by applicable intellectual property laws.

National and subdivision flags are in the public domain. The inclusion of any flag does not imply endorsement by or affiliation with any government entity.

You may not copy, modify, distribute, sell, or lease any part of the App or Website, nor may you reverse engineer or attempt to extract the source code.

8. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the service
• Interfere with or disrupt the service or servers
• Use offensive, vulgar, or inappropriate display names on leaderboards
• Exploit bugs or glitches rather than reporting them

9. Third-Party Services

The App and Website integrate with the following third-party services, each governed by their own terms and privacy policies:

• Apple Game Center — iOS leaderboards (Apple Terms of Service)
• Google Play Games Services — Android leaderboards (Google Terms of Service)
• Apple App Store / Google Play Store — In-app purchase processing
• Superwall — In-app purchase paywall management
• Firebase — Website authentication and data storage
• Vercel Analytics — Website anonymized usage analytics

10. Disclaimers

The App and Website are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the service will be uninterrupted, error-free, or free of harmful components.

FluentFlags is designed for educational and entertainment purposes. While we strive for accuracy in flag data and country information, we do not guarantee the completeness or accuracy of all content. Flag designs and geopolitical data may change over time.

11. Limitation of Liability

To the maximum extent permitted by applicable law, FluentFlags shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the service.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date. Your continued use of the App or Website after changes are posted constitutes your acceptance of the modified Terms.

13. Termination

You may stop using the service at any time by uninstalling the App or ceasing to access the Website. We reserve the right to suspend or terminate your access to the Website if you violate these Terms. Termination of the mobile app is not applicable as there is no account system — simply uninstalling the app removes all data.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law provisions.
